Data Processing Addendum (DPA)

AI SITE VISITTM (operated by Enlargenet)

This Data Processing Addendum (“DPA”) supplements the Terms and Conditions and Privacy Policy governing the use of the AI SITE VISITTM platform (operated by Enlargenet). This DPA applies to the processing of personal data collected during browser-based AI video calls, account registrations, and lead management activities.

1. Scope and Purpose of Processing

  • Roles of the Parties: For the purposes of processing real estate prospect leads, listing assets, and user account information, the Subscriber (Broker, Developer, Property Owner, or Master Franchisee) acts as the Data Controller, and Enlargenet acts as the Data Processor.
  • Subject Matter: Processing personal and technical data submitted to or collected by the AI SITE VISITTM platform during live, interactive AI-hosted video walkthroughs.
  • Duration: Processing will continue for the duration of the Subscriber's active subscription or agreement with Enlargenet.
  • Nature and Purpose: To deliver real-time, browser-based AI video calls, enforce the Pricing Firewall, route captured buyer leads to Controllers, process recurring SaaS payments, and maintain platform security.

2. Categories of Data and Data Subjects

A. Categories of Data Subjects:

  • End-prospects/buyers engaging in live AI video walkthroughs.
  • Account holders, real estate agents, developers, and Master Franchisee personnel.

B. Categories of Personal Data Processed:

  • Lead Contact Information: Name, mobile number, email address, and inquiry preferences.
  • Session Interaction Data: Voice queries, chat transcripts, room navigation choices, Vastu/layout preferences, and session duration.
  • Technical Metadata: IP addresses, browser types (Chrome, Safari, Edge), device categories, and campaign/traffic referral sources (Google Ads, Meta, QR codes, portals).

3. Processor Obligations (Enlargenet)

Enlargenet agrees and covenants to:

  • Process Data on Instructions: Process Personal Data solely in accordance with the documented instructions of the Data Controller, including the fulfillment of SaaS subscriptions and Master Franchise agreements.
  • Confidentiality: Ensure that personnel authorized to process Personal Data are bound by strict obligations of confidentiality.
  • Security Measures: Implement appropriate technical and organizational security safeguards—including data encryption in transit and at rest—to protect Personal Data against accidental loss, unauthorized access, or disclosure.
  • Sub-Processors: Inform Controllers of the use of trusted third-party sub-processors (such as cloud hosting providers, AI voice engines, and payment gateways) necessary to deliver core SaaS operations.
  • Data Incident Notification: Notify the Data Controller without undue delay upon becoming aware of a confirmed personal data breach affecting platform data.
  • Data Deletion & Return: Upon termination of services, delete or return all Personal Data to the Controller, subject to statutory tax, legal, and accounting retention requirements under Indian law.

4. Controller Obligations (Brokers, Developers, Franchisees)

The Data Controller warrants and agrees that:

  • It has obtained all necessary consents, authorizations, and legal grounds required to collect, share, and process Personal Data via the AI SITE VISITTM platform.
  • It will comply with applicable data protection laws, RERA guidelines, and privacy regulations regarding the management of leads generated through the platform.
  • It is solely responsible for the accuracy, legality, and integrity of property listings and customer data provided to the platform.

5. Security Certifications & Data Transfers

  • Browser-Native Isolation: Because AI SITE VISITTM operates natively inside standard web browsers without requiring executable app installations, local device vulnerability vectors are significantly minimized.
  • Cloud Infrastructure: Data is hosted and processed on secure, enterprise-grade cloud servers utilizing modern encryption protocols (TLS/SSL).

Enlargenet reserves the right to amend this Data Processing Addendum periodically to ensure ongoing compliance with legal, technical, and regulatory requirements. Updated versions will be published directly on this page.
